摘  要：随着科技的发展，沟通交流的重要性在日常生活中日益凸显，手机作为沟通的重要工具，其用户已超过8亿，同时发送手机欺诈性短信成为了一种新的犯罪手段。工信部于2010年9月1日正式实施电话用户实名登记制度。而手机实名制引起的最大争议就在于它与用户的通信自由、通信秘密及用户隐私权之间是否存在不可调和的矛盾。本文试从推行手机实名制引发的争议着手，讨论手机实名制与用户隐私权保护之间的关系。文章主要围绕手机实名制下完善用户隐私权的必要性、我国实施手机实名制存在的问题、国外实施手机实名制的经验、完善手机实名制下用户隐私权保障的措施几个方面来展开。

Mobile Phone Real Name System Under the Legal Protection of User Privacy
Abstract: With the development of science and technology, the importance of communication in daily life, highlighted increasingly mobile phones as an important tool of communication, the user has more than 8 million, while sending mobile phone text message became a fraudulent new crime means. Workers believe department in 2010 September 1 formally implementing telephone users real name registration system. But the biggest controversy caused real-name system is that it with a user's communication freedom, privacy between user privacy and whether there are irreconcilable conflict. This paper tries to push the issues raised by the real-name system to discuss real-name registration system and the relationship between users privacy protection.
